In accordance with Council Procedure Rule 4, the Committee noted the termination of membership of Councillor G Owen, and the appointment of Councillor R Molloy for this meeting only, thereby giving effect to the wishes of the political groups.

Party Whips are not to be used by this Committee in respect of its functions concerning the determination of applications, approval of consents, the taking of enforcement action and the exercise of powers and duties with regard to highways, hedgerows, the preservation of trees and high hedge complaints. When considering any other matter which relates to a decision of the Cabinet or the performance of any member of the Cabinet, in accordance with Regulatory Committee Procedure 9, Members must declare the existence of any party whip, and the nature of it.

The Assistant Director of Planning & Regulatory Services submitted a report on planning application 2024/0446/FUL - relating to Former Tile Giant 11 Hattersley Way, The Hattersley Centre, Ormskirk L39 2AN.

RESOLVED:That planning application 2024/0446/FUL be deferred at the request of the Committee in order to consider following various matters further:

·       Parking / car park connectivity

·       Anti-Social Behaviour measures

·       Health Impacts of proposal

·       Review of operating hours

·       Clarification of managing delivery drivers, signage etc.

Note 2: Councillor E Pope sought advice from legal during debate of this item.  Following advice, he declared a non-pecuniary interest as a Member of Lancashire County Council, and therefore took no further part in the debate or vote on this application.

The Assistant Director of Planning & Regulatory Services submitted a report on planning application 2024/0321/FUL, relating to Land off Lees Lane, Dalton.

RESOLVED:That planning application 2024/0321/FUL be approved subject to conditions as set out in the report, and further condition requested by Members relating to slurry being used solely for the farm.

Note: The Chairman varied the order of business, to allow this item to be heard first, at the request of Cllr Whittington.

The Assistant Director of Planning & Regulatory Services submitted a report on planning application 2024/0857/FUL, relating to 10 Briars Green, Skelmersdale WN8 6SQ.

RESOLVED:That planning application 2024/0857/FUL be deferred by officers prior to the meeting to allow consideration of further information addressing concerns from LCC Commissioning and other consultees.
