There were no urgent items of business.

Party Whips are not to be used by this Committee in respect of functions concerning the determination of new Licence Applications, Revocations and Appeals.  When considering any other matter which relates to a decision of the Cabinet, in accordance with Regulatory Committee Procedure Rule 9, Members must declare the existence of the Committee's deliberations on the matter.

RESOLVED: The minutes of the meeting held on 30 January 2023 be noted.

The Legal & Democratic Services Manager briefed everyone on the hearing procedure.

To consider the report of the Corporate Director of Place and Community.

Consideration was given to the report of the Corporate Director of Place and Community as contained on pages 287 to 348 of the Book of Reports in respect of an application under the Licensing Act 2003 for a new premise licence application in respect of Kaizan Sushi & Eatery, Unit 14 Burscough Wharf, Liverpool Road North, Burscough L40 5RZ.

RESOLVED: That the timings be granted as follows:

The following timings are given in the format below for clarity and apply whenever the specified licensable activities are taking place, but it is accepted that the Premises can operate in accordance with the provisions of the Live Music Act (as amended).

A.             That the premises shall be open to the public:-

                                           Sunday to Thurs – 12.00 noon until 23.00 hrs

Friday and Saturday – 12.00 noon until 00.30 hrs the next day

B.       That the sale/supply of alcohol shall be permitted on and off the premises:-

                                           Sunday to Thurs – 12.00 noon until 23.00 hrs

Friday and Saturday – 12.00 noon until 00.30 hrs the next day

C.        That the provision of live music shall be permitted                 Indoors only:- in accordance with the hours      permitted      under the Live Music Act (as      amended)

D.        That the provision of recorded music shall be    permitted      indoors only:-

                                           Sunday to Thurs –       12.00 noon until 23.00 hrs

Friday and Saturday – 12.00 noon until 00.30 hrs the next day

Non Standard Timings:

New Years Eve 12 noon until 02.00 the next day

E.         PROVISION OF ANYTHING OF A SIMILAR DESCRIPTION TO LIVE MUSIC, RECORDED   MUSIC OR PERFORMANCES OF DANCE shall be      permitted indoors only:-

                                           Sunday to Thurs – 12.00 noon until 23.00 hrs

Friday and Saturday – 12.00 noon until 00.30 hrs

Non Standard Timings:

New Years Eve 12 noon until 02.00 am the next day

F.       That the provision of late night refreshment shall be permitted:-

                                           Friday and Saturday – 23.00 to 00.30 hrs

                                           Conditions:

A.             The Committee wished to amend the Conditions agreed with the Police to state that documents/items are to be provided to any Responsible Authority and not just the Police.  Amendments shown in Red on Appendix 1 below.

B.             That a contact telephone number for the premises will be displayed on the front window/door of the Premises to allow anyone who wishes to report an issue directly to the premises to do so.  The said telephone must remain operational at all times licensable activities are taking place.
