APPLICATION FOR THE REVIEW OF A PREMISES LICENCE IN RESPECT OF WEST LANCS BUTCHERS AND DINER, WITHAM ROAD, SKELMERSDALE, WN8 8HP

To consider the report of the Assistant Director of Planning & Regulatory Services.

Minutes:

Consideration was given to the report of the Assistant Director of Planning and Regulatory Services, as contained on pages 13 to 138 of the Book of Reports and pages 143 to 148 and 151 to 220 of the Additional Information, which was to consider an application under the Licensing Act 2003 (the Act) for the Review of a Premises Licence in respect of West Lancs Butchers and Diner.

 

In considering this matter, the Sub-Committee had regard to its Licensing Policy, the Licensing Act 2003 and the guidance issued under S. 182 of the Licensing Act. It considered the relevant Licensing Objectives on this occasion was the 'Prevention of Crime & Disorder'.

 

The Sub-Committee considered whether these would be appropriate.

 

RESOLVED:

 

The Sub-Committee noted that the following conditions were referred to and agreed between the parties during the hearing -

 

A.   That Condition 18 in Annex 2 be amended as follows:

 

18.      All unsecured furniture, planters and barriers shall be removed       from the external seating area to the front of the premises by          20.30 hours. The area shall remain clear of all unsecured items     detailed above between 20.30 and 08.00. Once removed the     items shall be stored in a secure area, within the premises.

 

B.   The plan as submitted as part of the review application paperwork reflecting the current floor plan of the premises, be substituted as the plan of the premises to form part of the premises licence.

 

C.   In addition, the following conditions will be applied to the licence -

 

          1.              Only polycarbonate receptacles shall be used in the following            circumstances:

 

a.  when live football matches are televised at the premises. Live football matches are regarded as those stated as such on the advice of any Responsible Authority, and/or any FA Premier League, FA Cup, EFL Cup, EFL Championship, FIFA, and UEFA men's games.

 

b.  Any other event on request of any Responsible Authority.

 

          2.               The use of pool tables shall not be permitted at any time the use                of polycarbonate receptacles are required. During this period                    pool cues and balls shall be securely locked away.

 

This is the decision of the Licensing Sub-Committee.
